{"id":2003,"date":"2014-09-11T15:45:28","date_gmt":"2014-09-11T20:45:28","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=2003"},"modified":"2026-04-17T15:31:44","modified_gmt":"2026-04-17T20:31:44","slug":"september-12-2014-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/09\/11\/september-12-2014-weekly-round-up\/","title":{"rendered":"September 12, 2014 Weekly Round Up"},"content":{"rendered":"<p>It&#8217;s been busy in the ag law world.\u00a0 Here are a few of the stories and articles in the headlines over the last week.<\/p>\n<p><strong>* Two Groundwater District Approaches, One Aquifer.\u00a0<\/strong>\u00a0Neena Satija with the Texas Tribune wrote a great article discussing a controversy between Groundwater Conservation Districts managing the Corrizo-Wilcox aquifer in Central Texas.\u00a0 The Post Oak Savannah GCD and the Lost Pines GCD both manage groundwater for counties overlaying the same aquifer.\u00a0 Both, however, take different approaches to the permitting process.\u00a0 These differing approaches have allowed water marketers to obtain permits to pump millions of gallons of water from the Post Oak Savannah District, while marketers have been unable to obtain such rights from the Lost Pines GCD.\u00a0 This issue illustrates one of the difficulties with local groundwater control and inconsistent laws between various GCDs and likely highlights controversies that will continue to appear across the state. Aggie alum, Cari Rincker published a blog post offering legal tips for new parents.\u00a0 She&#8217;s got some great advice here and if you are expecting or have a young one, it is worth the read!\u00a0 [Read post <a href=\"http:\/\/rinckerlaw.com\/ten-legal-tips-new-parent\/\">here<\/a>.]<\/p>\n<div id=\"attachment_2033\" style=\"width: 410px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/JP.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-2033\" class=\"wp-image-2033\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/JP-300x199.jpg\" alt=\"\" width=\"400\" height=\"266\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/JP-300x199.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/JP.jpg 650w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a><p id=\"caption-attachment-2033\" class=\"wp-caption-text\">Photo via Britt Fisk, Clayton, NM<\/p><\/div>\n<p><strong>* House Passes Rule Preventing EPA&#8217;s Revised &#8220;Waters of the United States Definition.\u00a0 <\/strong>The United States House of Representatives passed a bill aimed at preventing the EPA&#8217;s proposed rule defining &#8220;waters of the United States&#8221; pursuant to the Clean Water Act.\u00a0 The &#8220;Waters of the United States Regulatory Overreach Protection Act of 2014&#8221; passed by a vote of 262-152.\u00a0 [Review bill text <a href=\"https:\/\/beta.congress.gov\/113\/bills\/hr5078\/BILLS-113hr5078rh.pdf\">here<\/a>.]\u00a0The bill would prohibit the EPA from\u00a0 expanding the scope of the Clean Water Act and would require federal and state cooperation to develop a regulatory proposal to define the scope of the Act. \u00a0It is considered unlikely that the bill will pass the Senate and the White House has indicated it will veto the bill if it were to reach\u00a0the President&#8217;s desk.\u00a0 [Read article <a href=\"http:\/\/www.nationaljournal.com\/library\/182132\">here.<\/a>]<\/p>\n<p><strong>* New Mexico Ranchers Sue Feds Over Mouse Protections.<\/strong>\u00a0 On Monday, several New Mexico ranchers and New Mexico agriculture groups files suit in the\u00a0federal court\u00a0claiming that the United States Forest Service wrongfully prevented livestock from watering in certain areas in order to protect the New Mexico jumping mouse, a species recently listed as endangered under the Endangered Species Act.\u00a0 [View <a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/09\/Complaint-here.pdf\">Complaint here<\/a>.]\u00a0 Specifically, the United States Forest Service has closed off areas\u00a0that it has\u00a0deemed an &#8220;occupied\u00a0habitat&#8221; for the mouse and, in doing so, prevents cattle from reaching water on federal land leased to ranchers for grazing purposes.\u00a0 This decision is challenged\u00a0by the ranchers who claim such actions are improper as the Forest Service relied upon flawed data to determine that cattle grazing harms the\u00a0jumping mouse\u00a0and because no formal designation of &#8220;critical habitat&#8221;
