{"id":1739,"date":"2014-07-16T10:52:38","date_gmt":"2014-07-16T15:52:38","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=1739"},"modified":"2026-04-17T15:32:05","modified_gmt":"2026-04-17T20:32:05","slug":"breaking-news-voters-will-have-final-say-on-fracking-in-denton","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/07\/16\/breaking-news-voters-will-have-final-say-on-fracking-in-denton\/","title":{"rendered":"Breaking News:  Voters Will Have Final Say on Fracking in Denton"},"content":{"rendered":"<p>Denton voters will have the final say on whether fracking will be permitted within city limits.<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/04\/2013083095105050.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1348 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/04\/2013083095105050-225x300.jpg\" alt=\"2013083095105050\" width=\"225\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/04\/2013083095105050-225x300.jpg 225w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/04\/2013083095105050-768x1024.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/04\/2013083095105050.jpg 1200w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/a><\/p>\n<p>Last night, the Denton City Council voted 5-2 to reject the petition and unanimously to place the issue on the November ballot and let voters decide whether to ban fracking within Denton.\u00a0 The vote came at approximately 3:00 am after eight hours of public discussion.\u00a0 More than 100 citizens spoke at the meeting and more than 500 people were in attendance.\u00a0 [Read more <a href=\"http:\/\/dfw.cbslocal.com\/2014\/07\/16\/denton-leaders-send-fracking-ban-to-voters\/\">here<\/a> and <a href=\"http:\/\/abcnews.go.com\/US\/wireStory\/denton-1st-texas-city-ban-fracking-24574274\">here<\/a>\u00a0and <a href=\"http:\/\/www.star-telegram.com\/2014\/07\/15\/5973161\/denton-fracking-ban-hearing-draws.html\">here<\/a>.]<\/p>\n<p>Earlier this year, nearly 2,000 residents signed a petition circulated by the Denton Drilling\u00a0Awareness Group\u00a0in favor of the ban, which required the city council to hold a public hearing on the petition.\u00a0 Currently, Denton has enacted a temporary fracking ban that expires in\u00a0September.\u00a0 If voters pass the\u00a0ballot initiative\u00a0in November, Denton will be the first Texas city to prohibit fracking.<\/p>\n<p>If passed in November, the fracking ban will almost certainly face extensive legal challenge from landowners, mineral owners, and\/or the oil and gas industry.\u00a0 One likely challenge is that municipalities do not have the authority to regulate oil and gas production as that power is given to the state-wide Texas Railroad Commission.\u00a0 A similar argument was recently <a href=\"http:\/\/agrilife.org\/texasaglaw\/2014\/06\/30\/breaking-news-new-yorks-highest-court-upholds-oil-and-gas-production-ban\/\">rejected in New York state<\/a>.\u00a0 Opponents also claim that this type of ban would constitute a regulatory taking, for which just compensation would be owed to the property owner.<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Denton voters will have the final say on whether fracking will be permitted within city limits.
