Shaw<\/em>, an important case\u00a0involving claims that the TCEQ&#8217;s issuance of water rights permits violated the Endangered Species Act.<\/p>\n<div id=\"attachment_628\" style=\"width: 235px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/cranes.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-628\" class=\"wp-image-628 size-medium\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/cranes-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/cranes-225x300.jpg 225w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/cranes.jpg 540w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/a><p id=\"caption-attachment-628\" class=\"wp-caption-text\">Photo via Kelly Huddleston, Santa Fe, NM<\/p><\/div>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Background<\/strong><\/span><\/p>\n<p>In 2008 and 2009, 23 whooping cranes, which are considered endangered under the Federal Endangered Species Act, allegedly died in the Aransas National Wildlife Refuge.\u00a0 This information was based on\u00a0a survey\u00a0by biologists.\u00a0 Only four carcasses were actually located.<\/p>\n<p>In 2010, The Aransas Project, and environmental group filed suit claiming that the birds&#8217; deaths were caused by the TCEQ&#8217;s issuance of water use permits allowing people to divert water from the rivers feeding the Refuge.\u00a0 This action, argued the plaintiffs, resulted in less water in the preserve, which in turn increased the salinity of the water, which\u00a0killed blue crabs and wolfberries\u00a0living in the water, upon which the whooping cranes fed,\u00a0all culminating in the death of the\u00a0whopping cranes.\u00a0 Plaintiffs argued that because the cranes are an endangered species,\u00a0their death\u00a0constituted an impermissible take under the Endangered Species Act.<\/p>\n<p>In 2013, a trial court judge found that the TCEQ&#8217;s issuance of permits on the\u00a0rivers feeding the estuary\u00a0violated the Endangered Species Act and barred the TCEQ from issuing additional permits for water\u00a0 use from the rivers.\u00a0\u00a0The Aransas Project\u00a0sought and was granted an injunction prohibiting TCEQ from issuing new permits to withdraw water from rivers that feed the\u00a0Refuge where the cranes make their winter home.<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Fifth Circuit Decision<\/strong><\/span><\/p>\n<p>The three-judge Fifth Circuit panel reversed. [Read full opinion <a href=\"http:\/\/www.ca5.uscourts.gov\/opinions\/pub\/13\/13-40317-CV0.pdf\">here<\/a>.]\u00a0 As stated by the court, the key issue in this case is\u00a0&#8220;whether the actions of TCEQ in administering licenses to take water from the Guadalupe and San Antonio rivers for human, manufacturing and agricultural use foreseeably and proximately caused the deaths of whooping cranes in the winter of 2008\u20132009.&#8221;<\/p>\n<p>The court found that the lower court failed to adequately determine whether the TCEQ&#8217;s actions were the cause of the cranes&#8217; deaths.\u00a0 In discussing the lower court&#8217;s opinion, the Fifth Circuit noted, &#8220;nowhere does the court explain why the remote connection between water licensing, decisions to draw river water by hundreds of users, whooping crane habitat, and crane deaths that occurred during a year of extraordinary drought compels Endangered Species Act liability.&#8221;\u00a0 The opinion continued,\u00a0&#8220;[t]here is a long chain of causation here between the TCEQ\u2019s issuance of permits to take water from the rivers and cranes\u2019 mortality&#8230;Every link of this chain depends on modeling and estimation. Proximate cause, however, requires the causal factors and the result to be reasonably foreseeable.&#8221;<\/p>\n<p>Thus, in conclusion, the court stated, &#8220;[b]ecause the deaths of the whooping cranes are too remote from TCEQ\u2019s permitting withdrawal of water from the San Antonio and Guadalupe Rivers, the state defendants cannot be held liable for a take or for causing a take under the ESA.&#8221;<\/p>\n<p>The Aransas project now has 14 days to determine if it will seek rehearing before the entire\u00a05th Circuit and 90 days to determine whether it will appeal the ruling to the United States Supreme Court.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Fifth Circuit Court of Appeals reversed a lower court decision\u00a0last week in Aransas Project v.
