Durnell<\/em> finding state law labeling claims pre-empted.<\/strong>\u00a0 Last week, the United States Supreme Court issued its <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/24-1068_n7ip.pdf\">decision<\/a> in <em>Durnell v. Monsanto<\/em>.\u00a0 You read about this case previously <a href=\"https:\/\/agrilife.org\/texasaglaw\/2026\/03\/08\/us-supreme-court-to-hear-case-on-pesticide-preemption\/\">here<\/a>.\u00a0 The Court ruled that Mr. Durnell&#8217;s state law failure to warn claims are preempted by federal law.\u00a0 We had a complete blog post and a short summary of the decision <a href=\"https:\/\/agrilife.org\/texasaglaw\/2026\/06\/26\/us-supreme-court-failure-to-warn-claims-preempted-by-fifra\/\">here<\/a>.<\/p>\n<p><strong>* New World Screwworm confirmed in Texas.<\/strong>\u00a0 There have been several cases of New World Screwworm confirmed in Texas and one case in New Mexico.\u00a0 We wrote a <a href=\"https:\/\/agrilife.org\/texasaglaw\/2026\/06\/10\/new-world-screwworm-in-texas-what-texans-need-to-know\/\">blog post<\/a> and recorded a <a href=\"https:\/\/www.youtube.com\/watch?v=55KTVHSgLow\">video<\/a> discussing some of the legal and regulatory issues to keep in mind.\u00a0 We also collected our main sources of trusted information in one <a href=\"https:\/\/qrfy.io\/p\/NWS\">link tree<\/a> for you to easily access.<\/p>\n<p>* <strong>United States Supreme Court approved settlement in long-running <em>Texas v. New Mexico<\/em> water case.<\/strong>\u00a0 For over a decade, we have followed a lawsuit involving Texas&#8217; claims that New Mexico was violating a compact to allocate waters of the Rio Grande.\u00a0 You can read more background <a href=\"https:\/\/agrilife.org\/texasaglaw\/2013\/09\/18\/texas-water-wars-texas-v-new-mexico\/\">here.<\/a>\u00a0 This month, the United States Supreme Court <a href=\"https:\/\/www.texastribune.org\/2026\/05\/28\/texas-new-mexico-rio-grande-water-dispute-supreme-court-settlement\/#:~:text=Under%20the%20settlement%2C%20New%20Mexico,within%20the%20next%20five%20years.\">approved a settlement<\/a> in the case.\u00a0 As part of the settlement, New Mexico farmers along the Rio Grande will have to cut groundwater usage.<\/p>\n<p><strong>*USDA issues guidance on new payment limitation and eligibility rules.<\/strong>\u00a0 The USDA recently released guidance for implementing the payment limitation and eligibility provisions included in the One Big Beautiful Bill Act, including the significant changes to how qualified pass through entities like LLCs are treated.\u00a0 Kristine Tidgren at Iowa State wrote a <a href=\"https:\/\/www.calt.iastate.edu\/post\/usda-issues-new-payment-limitation-and-eligibility-rules\">great article<\/a> summarizing the new guidance.<\/p>\n<p><strong>\u00a0* Article on data centers.<\/strong>\u00a0 I enjoyed <a href=\"https:\/\/www.texasagriculturepolicy.com\/post\/texas-data-center-policy\">this article<\/a> by Cahil Murchison discussing data center development in Texas.\u00a0 An important point he makes (and one I have been telling people on an almost daily basis) is that there are currently absolutely no Texas laws dealing specifically with data centers.<\/p>\n<p><strong>* Department of Homeland Security published guidance for dairy farms seeking H-2A labor.\u00a0 <\/strong>DHS <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/policy-alerts\/PM-602-0200-H2APetitionsForDairying-20260617.pdf\">issued guidance<\/a> for dairy producers clarifying that dairies can be eligible to hire temporary or seasonal labor under the H-2A visa program, even though dairy cows typically require milking and care year-round.\u00a0 The application will be evaluated under the same criteria as other H-2A visa applications, and seasonal or temporary need must be described.<\/p>\n<p><strong>* The US Fish and Wildlife Service agrees to revoke listing for dunes sagebrush lizard.<\/strong>\u00a0 The US Fish and Wildlife Service has <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/us-revokes-endangered-species-listing-permian-basin-lizard-resolves-texas-2026-06-04\/\">agreed to revok<\/a>e the Endangered Species Act listing of the dunes sagebrush lizard.\u00a0 This settles a lawsuit that was brought by the State of Texas challenging the listing in 2024. This revocation and settlement must be approved by the federal judge in the case.\u00a0 The Center for Biological Diversity has <a href=\"https:\/\/s3-us-west-2.amazonaws.com\/s3-wagtail.biolgicaldiversity.org\/documents\/26-06-05-Renewed-Motion-to-Intervene-dunes-sagebrush-lizard.pdf\">filed a request<\/a> to intervene to oppose the USFWS plan to revoke the protections.<\/p>\n<p><strong>*<\/strong> <strong>Objections filed to Roundup Settlement.<\/strong> Earlier this month, a Missouri federal judge <a href=\"https:\/\/nationalaglawcenter.org\/wp-content\/uploads\/2026\/06\/request-to-remand-MO-roundup-settlement-5.22.226.pdf\">rejected<\/a> attempts by settlement opponents to have the proposed settlement transferred to a California federal court. Instead, he ruled the case will remain in Missouri State Court.\u00a0 That decision has been appealed to the United States Court of Appeals for the Eighth Circuit.<\/p>\n<p><strong>* Dairy checkoff challenged in court.<\/strong>\u00a0 Three Wisconsin dairy farmers have <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.wied.117133\/gov.uscourts.wied.117133.1.0.pdf\">filed suit<\/a> against the USDA claiming that the dairy checkoff program is unconstitutional. The producers claim that their checkoff funds (15 cents\/hundredweight of milk) are being used to support a private non-profit that has an ESG agenda.
