Sunlight streams through trees, casting a warm glow over the lush blue and green landscape.<\/em><\/p><\/div>\n<p>&nbsp;<\/p>\n<p><strong>*John Deere agrees to $99 million settlement in right-to-repair class action lawsuit.<\/strong>\u00a0 John Deere has agreed to pay $99 million to settle a class action lawsuit claiming that Deere made crucial repair tools and software updates unavailable to independent repair shops and farmers.\u00a0 Those included in the class are individuals or entities who purchased repair services for John Deere large agricultural equipment from January 2018 until the settlement date.\u00a0 This, the plaintiffs argued, allowed them a monopoly and the ability to artificially increase prices.\u00a0 In addition to the monetary payout, the settlement will require Deere to make the necessary tools available to diagnose and repair problems to independent repair shops and farmers for 10 years.\u00a0 The settlement is not final until it is approved by the court.\u00a0 Importantly, this settlement does not impact a second lawsuit in which the Federal Trade Commission sued John Deere for the same actions.\u00a0 That suit remains ongoing.\u00a0 [Read article <a href=\"https:\/\/www.farmprogress.com\/farming-equipment\/john-deere-settles-right-to-repair-lawsuit-for-99-million\">here<\/a>.\u00a0 View proposed settlement <a href=\"https:\/\/nationalaglawcenter.org\/wp-content\/uploads\/2026\/04\/gov.uscourts.ilnd_.415798.333.3.pdf\">here<\/a>.]\u00a0 \u00a0We are also releasing an episode of the <a href=\"https:\/\/aglaw.libsyn.com\/\">Ag Law in the Field Podcast<\/a> on this topic next week.<\/p>\n<p><strong>*US Supreme Court decision in\u00a0<em>Monsanto v. Durnell<\/em> could impact ability to sue pesticide manufacturers.<\/strong>\u00a0 The Texas Standard recently published <a href=\"https:\/\/www.texasstandard.org\/stories\/bayer-faces-thousands-of-roundup-cancer-lawsuits-a-supreme-court-ruling-may-make-it-harder-to-sue\/\">an article<\/a> on the potential impact of the US Supreme Court&#8217;s upcoming decision in\u00a0<em>Monsanto v. Durnell<\/em> in which the reporter spoke to two friends of mine and great ag lawyers, Brigit Rollins and Jennie Zwagerman. They did a great job of laying out the arguments of the parties and issues of the case.\u00a0 We also wrote a blog post highlighting this case <a href=\"https:\/\/agrilife.org\/texasaglaw\/2026\/03\/08\/us-supreme-court-to-hear-case-on-pesticide-preemption\/\">here<\/a>.\u00a0 For folks interested in learning more on this topic, the National Agricultural Law Center will be hosting a <a href=\"https:\/\/nationalaglawcenter.org\/webinars\/pesticide-labeling\/\">webinar<\/a> discussing the issue of failure to warn on May 20, 2026.<\/p>\n<p><strong>*USDA publishes New World Screwworm Response Playbook.<\/strong>\u00a0 The USDA has released an <a href=\"https:\/\/www.aphis.usda.gov\/news\/agency-announcements\/usda-releases-updated-new-world-screwworm-response-playbook\">updated guide<\/a> related to the response should the New World Screwworm be detected in the United States.\u00a0 This is one topic that we will be discussing at the upcoming State Bar of Texas John Huffaker Agricultural Law CLE.\u00a0 We will be publishing a paper next month on this topic that we will certainly share here.<\/p>\n<p><strong>*Texas Supreme Court opinion addresses what &#8220;free of all costs&#8221; means&#8230;it&#8217;s not what you think.<\/strong>\u00a0 The Texas Supreme Court recently decided\u00a0<em>Fasken v. Puig<\/em>, a case involving the meaning of the words &#8220;free of all costs&#8221; in the reservation of a royalty interest.\u00a0 The Court held that this language did not intend to exclude post-production costs.\u00a0 This means that the oil and gas operator is allowed to deduct post-production costs from the royalties due to the royalty owner under this lease.\u00a0 Read the Opinion <a href=\"https:\/\/search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=80bec5cf-f393-492e-bd9c-e75df3c275a0&amp;coa=cossup&amp;DT=OPINION&amp;MediaID=a30574a8-ce49-4258-b2d5-4d6f6300ab5c\">here<\/a> and a good summary by John McFarland on his blog <a href=\"https:\/\/www.oilandgaslawyerblog.com\/fasken-v-puig-what-does-free-of-all-costs-mean\/\">here<\/a>.<\/p>\n<p><strong>*Tenth Circuit affirms New Mexico Supreme Court decision regarding public access to streambeds.<\/strong>\u00a0 In <em>Sanchez v. Torrez<\/em>, the United States Court of Appeals for the Tenth Circuit affirmed the dismissal of a case where New Mexico landowners challenged the State&#8217;s position that streambeds are open to the public.\u00a0 Read Opinion <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2026\/04\/lucia-sanchez-new-mexico-opinion.pdf\">here<\/a>.<\/p>\n<p><strong>*Farmer mental health matters.<\/strong>\u00a0 I loved a <a href=\"https:\/\/www.farmprogress.com\/farm-life\/farmers-your-mental-health-matters-take-the-first-step-today?utm_rid=CPG02000000698080&amp;utm_campaign=106399&amp;utm_medium=email&amp;elq2=394dfeceb9754de793c60e39b023a920&amp;sp_eh=106890a768b20d3416a11199e053523fc02ec5e24c7e7f05b665a994aee074ff\">recent article<\/a> by Jennifer Latzke focused on farmer mental health.
