Monsanto<\/em>, a lawsuit focused on whether federal pesticide law preempts state products liability claims. Specifically, the lawsuit centers on whether Monsanto, the manufacturer of Roundup, failed to warn consumers that Roundup might cause cancer. Around the country, a circuit split has developed on the question of whether state law claims are preempted by the Federal Insecticide, Fungicide, and Rodenticide Act.\u00a0 \u00a0[Read article <a href=\"https:\/\/nationalaglawcenter.org\/supreme-court-agrees-to-hear-pesticide-preemption-lawsuit\/\">here<\/a>.]<\/p>\n<p><strong>*Data centers dominate media coverage, policy discussions.<\/strong>\u00a0 Data centers continue to be a hot topic of conversation.\u00a0 Just this month, we released a <a href=\"https:\/\/aglaw.libsyn.com\/episode-213-chris-nichols-data-centers\">podcast episode<\/a> discussing data centers and common legal issues.\u00a0 Texas Agricultural Commissioner, Sid Miller, recently announced a new proposal to utilize Agricultural Freedom Zones to &#8220;guide data center development to appropriate areas.&#8221;\u00a0 [Read press release <a href=\"https:\/\/texasagriculture.gov\/News-Events\/Article\/10742\/Commissioner-Miller-Calls-Upon-State-and-Federal-Legislators-to-Protect-Vital-F\">here<\/a>.]\u00a0 Farm Progress is publishing a series called &#8220;<a href=\"https:\/\/www.farmprogress.com\/keyword\/paved-over\">Paved Over<\/a>,&#8221; which looks at the impact of technology on agriculture, including <a href=\"https:\/\/www.farmprogress.com\/conservation-and-sustainability\/data-center-payouts-are-huge-saving-farmland-priceless?utm_rid=CPG02000000698080&amp;utm_campaign=104342&amp;utm_medium=email&amp;elq2=8d270164a78341e3b65c5c6fb58a844c&amp;sp_eh=106890a768b20d3416a11199e053523fc02ec5e24c7e7f05b665a994aee074ff\">this article<\/a> on data centers.<\/p>\n<p><strong>*Texas landowners appeal PFAS decision.<\/strong>\u00a0 Plaintiffs are appealing a federal court decision which held that the EPA has no duty to regulate PFAS in biosolids.\u00a0 The court held that\u00a0 while the Clean Water Act does require the EPA to review regulations related to &#8220;sewage sludge&#8221; every-other-year, there is no similar timeline for when the EAP must adopt new regulations.\u00a0 The Plaintiffs have filed an appeal.<\/p>\n<p><strong>*Texas landowner sues oil and gas companies over saltwater injection wells.<\/strong>\u00a0 A Crane County landowner has filed suit against eight oil and gas companies claiming their improper operation of injection wells and improper plugging of old wells has caused &#8220;catastrophic impacts&#8221; to his land. [Read article <a href=\"https:\/\/insideclimatenews.org\/news\/28012026\/new-lawsuit-claims-catastrophic-impacts-from-permian-basin-injection-wells\/\">here<\/a>.]<\/p>\n<p><strong>* Exxon Mobil sues California challenging climate disclosure laws.<\/strong>\u00a0 Exxon Mobil has filed suit challenging California&#8217;s climate disclosure laws. [Read article <a href=\"https:\/\/www.cnbc.com\/2025\/10\/25\/exxonmobil-sues-california-over-climate-disclosure-laws.html\">here<\/a>.]\u00a0 For background on the climate disclosure laws at issue, check out <a href=\"https:\/\/aglaw.libsyn.com\/episode-175-megan-houdeshel-kayla-race-climate-disclosure-laws-and-regulations\">this prior podcast episode<\/a>.<\/p>\n<p><strong>*North Dakota court strikes down carbon capture law.<\/strong>\u00a0 In an interesting case out of North Dakota,\u00a0<em>Northwest Landowners Association v. North Dakota<\/em>, involves a state law providing that once a carbon capture project is completed, the title to both the storage location and the CO2 held in storage is transferred to the state.\u00a0 The trial court held that this law, which does not require any compensation to landowners in this scenario, constitutes an unconstitutional taking of private property without just compensation.\u00a0 [Read Order <a href=\"https:\/\/northdakotamonitor.com\/wp-content\/uploads\/2025\/12\/nwla-opinion.pdf\">here<\/a>.]<\/p>\n<p><strong>*Article outlines expansion of USDA payment limit eligibility for certain LLCs under One Big Beautiful Bill Act. <\/strong>The Prairie Farmer recently published an article highlighting the changes that the One Big Beautiful Bill Act made to USDA program payment limits.\u00a0 Under the new law, LLCs and S-corporations taxed as partnerships will qualify for multiple payment limits&#8211;allowing each qualifying member actively engaged in farming to receive up to a payment limit.\u00a0 Previously, these entities were limited to one limit per entity.
