[Read article <a href=\"https:\/\/www.dtnpf.com\/agriculture\/web\/ag\/news\/business-inputs\/article\/2025\/12\/17\/texas-files-lawsuit-xcel-energy\">here<\/a> and Complaint <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Petition_5.pdf\">here<\/a>.]<\/p>\n<p><strong>*Texas landowners appeal decision in PFAS lawsuit against the EPA.<\/strong>\u00a0 A group of Texas landowners have filed an appeal after a federal judge found the EPA does not have a duty to regulate PFAS in biosolids under a two-year time requirement pursuant to the Clean Water Act.\u00a0 Brigit Rollins at the National Agricultural Law Center wrote a <a href=\"https:\/\/nationalaglawcenter.org\/court-dismisses-pfas-case-brought-by-farmers-against-epa\/\">great article<\/a> explaining the trial court&#8217;s decision.<\/p>\n<p><strong>*North Dakota trail court found law on carbon capture storage unconstitutional.<\/strong>\u00a0 An important case out of North Dakota involving carbon capture and sequestration was decided earlier this month.\u00a0 The court in\u00a0<em>North Dakota Landowners Association<\/em>\u00a0<em>v. North Dakota<\/em> held that a portion of North Dakota&#8217;s carbon storage law was unconstitutional.\u00a0 Specifically, the court found that the law allows the forced use of underground pore space without providing the required just compensation for landowners, resulting in an unconstitutional taking of private property.
