A couple of week ago, a New World Screwworm case was found just 70 miles south of the Texas Border in Nuevo Leon, Mexico.\u00a0 [Read article <a href=\"https:\/\/southernagtoday.org\/2025\/09\/25\/threat-looms-and-urgency-grows-as-new-world-screwworm-inches-closer-to-the-texas-mexico-border\/\">here<\/a>.]\u00a0 This week, another case was reported 170 miles from the border.\u00a0 [Read article <a href=\"https:\/\/southeastagnet.com\/2025\/10\/09\/new-world-screwworm-case-mexico-usda-response-2025\/\">here<\/a>.]\u00a0 Also in the last two weeks, the FDA conditionally approved the first product to prevent and treat New World Screwworm, Dectomax-CA1.\u00a0 [Read press release <a href=\"https:\/\/www.fda.gov\/news-events\/press-announcements\/fda-conditionally-approves-first-drug-prevention-and-treatment-new-world-screwworm-infestations\">here<\/a>.] Remember, Texas A&amp;M AgriLife has its own dedicated <a href=\"https:\/\/agrilifeextension.tamu.edu\/new-world-screwworm\">New World Screwworm page<\/a> with lots of information.<\/p>\n<p><strong>* Plaintiffs appeal decision upholding air emissions reporting exception for livestock and poultry producers.<\/strong>\u00a0 You may recall from <a href=\"https:\/\/agrilife.org\/texasaglaw\/2025\/09\/08\/federal-court-upholds-air-emissions-exemption-for-livestock-poultry-operations\/\">this prior article<\/a> that the United Stated District Court for the District of Columbia recently upheld an exemption to air emissions reporting for livestock and poultry operations.\u00a0 The plaintiffs have filed an appeal to that decision.\u00a0 [Read Notice of Appeal <a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/2025\/10\/notice-of-appeal_epa_factoryfarm_oct32025.pdf\">here<\/a>.]<\/p>\n<p><strong>*Special master to consider another proposed settlement in <em>Texas v. New Mexico<\/em> lawsuit.\u00a0<\/strong>Last week, a special master was presented and will now consider a proposed settlement between the parties in\u00a0<em>Texas v. New Mexico<\/em>, a decades long lawsuit regarding the Rio Grande river.\u00a0 [Read article <a href=\"https:\/\/www.santafenewmexican.com\/news\/special-master-to-hear-settlement-in-suit-tied-to-rio-grande-compact-this-week\/article_4fd770fc-29ae-4aad-8448-50e6d3c5e02d.html\">here<\/a>.]<\/p>\n<p><strong>*North Dakota farmers seek review of eminent domain lawsuit by US Supreme Court.<\/strong>\u00a0 North Dakota landowners who fought what they believed was a lowball offer in an eminent domain lawsuit and received a significantly higher award than that initial offer after a trial.\u00a0 A trial court judge awarded the landowners reimbursement of their attorney&#8217;s fees. The US Court of Appeals for the Eighth Circuit reversed this attorney fee ruling.\u00a0 The landowners are now seeking review before the US Supreme Court. [Read article <a href=\"https:\/\/www.agweb.com\/news\/business\/farmland\/lowballed-eminent-domain-nd-farmers-appeal-landmark-case-supreme-court\">here<\/a>.]\u00a0 Additionally, the attorneys general from 12 states, including Texas, have filed an <em>amicus curiae<\/em> brief asking the court to take the case. [Read brief <a href=\"https:\/\/ij.org\/wp-content\/uploads\/2025\/09\/States-Amicus-Brief-ND-Natural-Gas.pdf\">here<\/a>.]<\/p>\n<p><strong>*Triumph Food files suit challenging constitutionality of California Proposition 12.\u00a0\u00a0<\/strong>Triumph Foods has filed a lawsuit claiming that Proposition 12 unlawfully discriminates against out-of-state pork producers and processors.\u00a0 Triumph successfully brought a similar challenge against the same language in Massachusetts&#8217; law Question 3.\u00a0 The lawsuit claims that by offering an exception to the Prop 12 requirements for federally inspected facilities, it discriminates against out-of-state producers and facilities who are required to comply with the Prop 12 standards.
