COG Operating<\/em><\/strong>.\u00a0 The biggest news in Texas has to be the Court&#8217;s decision regarding produced water.\u00a0 This case asked the question of whether produced water&#8211;water that is extracted with oil and gas production&#8211;belongs to the surface owner or the mineral lessee. The Court held that when an oil and gas lease is executed, the produced water conveys with the mineral rights.\u00a0 To read more on this decision, <a href=\"https:\/\/agrilife.org\/texasaglaw\/2025\/06\/30\/texas-supreme-court-produced-water-owned-by-mineral-lessee\/\">click here<\/a>.\u00a0 Additionally, to read more about the unanswered question of what this means for lithium extraction, <a href=\"https:\/\/www.gravel2gavel.com\/produced-water-ownership-critical-mineral-texas-supreme-court\/\">here<\/a> is a really interesting article.<\/p>\n<p><strong>*United States Supreme Court limits use of nationwide injunctions.<\/strong>\u00a0 The United States Supreme Court issued a decision in\u00a0<em>Trump v. CASA.\u00a0\u00a0<\/em>The Opinion was authored by Justice Amy Coney Barrett with the Justices split 6-3 along ideological lines.\u00a0 Though this case is about the legality of the Trump administration ending birthright citizenship by Executive Order, the Supreme Court did not address the merits.\u00a0 Instead, the Court focused only on the issue of whether the lower courts were proper in issuing nationwide injunctions against the Executive Order.\u00a0 Justice Barrett&#8217;s majority opinion focused on the use of nationwide injunctions historically, and pointed out that they are a relatively recent tool.\u00a0 Because of this, the Court found, federal courts do not have the authority to issue nationwide injunctions in most circumstances.\u00a0 Exceptions to this may exist for certain situations such as class actions, for example.\u00a0 The case was remanded for the lower courts to determine whether the injunctions should be narrowed in light of the Court&#8217;s ruling.\u00a0 There were also a litany of concurring opinions as well as dissenting opinions from Justices Sotomayor and Jackson.\u00a0 [Read Opinions <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24a884_8n59.pdf\">here<\/a>.]<\/p>\n<p><strong>*US Supreme Court will not hear next Proposition 12 case.<\/strong>\u00a0 The\u00a0 United States Supreme Court has denied certiorari in <em>Iowa Pork Producers Association v. Bonta<\/em>.\u00a0 The appeal was from a decision of the United States Court of Appeals for the Ninth Circuit challenging the constitutionality of Proposition 12.\u00a0 You might recall in 2023, the US Supreme Court upheld Proposition 12.\u00a0 [Read more about that <a href=\"https:\/\/agrilife.org\/texasaglaw\/2023\/05\/17\/united-states-supreme-court-allows-proposition-12-to-stand\/\">here<\/a>.]\u00a0 In that decision, 5 justices held that while the plaintiffs there failed to prove a substantial burden on interstate commerce, there was the possibility of facts being alleged in another case that might successfully prove such a burden.\u00a0 It was that burden the Iowa Pork Producers Association (along with numerous other state plaintiffs) sought to prove in this case.\u00a0 The Court will not, however, be taking the case for review.\u00a0 [Read article <a href=\"https:\/\/www.dtnpf.com\/agriculture\/web\/ag\/livestock\/article\/2025\/06\/30\/supreme-court-denies-iowa-pork-12\">here<\/a>.]<\/p>\n<p><strong>*Court finds Swampbuster constitutional.<\/strong>\u00a0 About a month ago, the United States District Court for the Northern District of Iowa ruled the wetlands conservation program (known as &#8220;Swampbuster&#8221;) to be constitutional in <em>CTM Holdings v. USDA<\/em>.\u00a0 A landowner challenged the program as violating the commerce clause and constituting a taking of private property.\u00a0 The court disagreed, upholding the program.\u00a0 Read the Opinion <a href=\"https:\/\/www.foodandwaterwatch.org\/wp-content\/uploads\/2025\/05\/Swampbuster-Ruling.pdf\">here<\/a> and a great summary by Brigit Rollins <a href=\"https:\/\/nationalaglawcenter.org\/federal-court-finds-swampbuster-constitutional\/\">here<\/a>.<\/p>\n<p><strong>*Right to Repair antitrust lawsuit against John Deere to proceed.<\/strong>\u00a0 A judge in the US District Court for the Northern District of Illinois ruled that a lawsuit filed by the FTC alleging antitrust violations by John Deere related to right to repair will go forward.\u00a0 A number of other states joined the FTC as plaintiffs in the case.\u00a0 \u00a0It will now proceed to discovery.\u00a0 [Read article <a href=\"https:\/\/www.agriculture.com\/deere-must-face-ftc-right-to-repair-lawsuit-judge-rules-11752414\">here.<\/a>]<\/p>\n<p><strong>*Further delay of the Horse Protection Act amendments.<\/strong>\u00a0 Someone asked me a question on this last week.\u00a0 You might recall back in May 2024, USDA APHIS passed a final rule amending horse protection act regulations.\u00a0 Specifically, the regulations\u00a0 addressed the &#8220;soring&#8221; of horses.\u00a0 Initially, the amendments were set to go into effect on February 1, 2025.\u00a0 They were then delayed until April 2, 2025, and have now been further delayed until February 1, 2026.\u00a0 [Read rule <a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/03\/21\/2025-04813\/horse-protection-amendments-further-delay-of-effective-date-and-request-for-comment\">here<\/a>.]<\/p>\n<p><strong>*AI generated legal documents reviewed.<\/strong>\u00a0 I&#8217;ve seen (and co-authored) a couple of articles looking at AI generated legal documents.\u00a0 Jesse Richardson and I wrote an article for Southern Ag Today looking at the use of AI in drafting a will.\u00a0 [Read article <a href=\"https:\/\/southernagtoday.org\/2025\/06\/20\/who-needs-attorneys-when-you-have-ai\/\">here<\/a>.]\u00a0 Our conclusion?\u00a0 While AI may be useful in gathering information and conducting research, we recommend using an actual attorney to draft legal documents.\u00a0 Another article looked at using AI to generate a farm lease agreement.\u00a0 Todd gave the AI contract a B, noting it was likely better than no written lease at all, but not as desirable as a lease drafted by a human attorney.\u00a0 [Read article <a href=\"https:\/\/www.aglaw.us\/janzenaglaw\/2025\/4\/25\/is-an-ai-drafted-contract-better-than-no-contract\">here<\/a>.]<\/p>\n<p style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>Upcoming Programs<\/strong><\/span><\/p>\n<p>Next week, I will have a full docket with speaking engagements on Wednesday, July 9 in Ft.
