{"id":1388,"date":"2014-05-08T17:59:33","date_gmt":"2014-05-08T22:59:33","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=1388"},"modified":"2026-04-17T15:32:40","modified_gmt":"2026-04-17T20:32:40","slug":"may-9-2014-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/05\/08\/may-9-2014-weekly-round-up\/","title":{"rendered":"May 9, 2014 Weekly Round Up"},"content":{"rendered":"<p>Things continue to be busy around here with lots of programs going on.\u00a0 Last week, I spoke on grazing leases and the\u00a0Texas Right to Farm Act\u00a0at an Agribusiness 101 session for Travis and Bastrop Counties in Austin.\u00a0 Thank you to County Extension Agents Julie Ansley and Rachel Bauer for the invitation!\u00a0 Last Friday, I made the drive to Nacogdoches to speak on basic estate planning at a Value of Land Seminar hosted by the Nacogdoches and Angelina County Extension Offices.\u00a0 Jamie Sugg and Cary Sims did a great job putting this program together and I enjoyed the chance to speak.\u00a0 Finally, this week I was able to present to a group of 28 women at the Annie&#8217;s Project in Georgetown.\u00a0 Agrilife Extension District Economist Jason Johnson does an outstanding\u00a0with this program, designed to educate farm and ranch women.\u00a0 These ladies\u00a0had about two hours worth of great questions and it was a pleasure to attend and visit with them.<\/p>\n<p>To all of you new followers from these presentations, welcome!<\/p>\n<p>Here are a few ag law stories in the news.<\/p>\n<p><strong>*\u00a0 Texas Rancher Questions &#8220;Wiggle Room&#8221; for Transmission Lines.<\/strong>\u00a0 A Texas rancher is fighting against the &#8220;wiggle room&#8221; that a transmission line company says it is afforded in determining where to place its line.\u00a0 The transmission line at issue, part of the CREZ initiative, will connect wind power production in west Texas with end-users in Dallas.\u00a0 The project received approval for their route&#8211;which goes through Mr. Vinson&#8217;s property&#8211;\u00a0from the Public Utility Commission.\u00a0 The company, however, now seeks to place the line approximately 150 feet from the original mapped location, claiming that they have the authority to slightly deviate from the mapped location.\u00a0 This\u00a0dispute has raised an interesting question of whether transmission line companies can modify the location of the lines after receiving PUC approval and after compensating landowners for the planned route.\u00a0 After an administrative law judge sided with the company and against Mr. Vinson, he appealed to the Public Utility Commission. \u00a0Next month, the PUC will consider this issue pursuant to a complaint filed by Mr. Vinson.\u00a0 [Read article <a href=\"http:\/\/www.texastribune.org\/2014\/04\/18\/power-line-dispute-rancher-questions-wiggle-room\/\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/photo-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-615 aligncenter\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/photo-2-225x300.jpg\" alt=\"photo (2)\" width=\"225\" height=\"300\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/photo-2-225x300.jpg 225w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/photo-2-768x1024.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2013\/10\/photo-2.jpg 1224w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/a><\/p>\n<p><strong>* Oil and Gas Boom Leads To Increase in Traffic Accidents.<\/strong>\u00a0 Throughout the country from West Virginia to Texas, areas that are part of the country&#8217;s oil boom are also dealing with increased numbers of traffic fatalities.\u00a0 According to this article, in Texas, traffic fatalities were up 18% in a twenty-one county area where drilling has expanded, while in the rest of the state, fatalities are down\u00a020%.\u00a0\u00a0Numerous factors contribute to this\u00a0issue including increased traffic, additional heavy equipment on the roads, and\u00a0overwhelming\u00a0growth in traffic for which local infrastructure is inadequate.\u00a0 [Read article <a href=\"http:\/\/bigstory.ap.org\/article\/ap-impact-deadly-side-effect-fracking-boom-0\">here<\/a>.]<\/p>\n<p><strong>* Article Explains Importance of Estate Plan Regardless of Wealth.<\/strong>\u00a0 A recent Dallas Morning News article explained the importance of estate plans even for those of us without large bank accounts.\u00a0 As the article explains, it is important for everyone to think through various aspects of an estate plan including bequeathing assets, but also things like granting powers of attorney for financial and healthcare decisions, considering drafting living wills and do not resuscitate orders, and preparing a list of assets.\u00a0 [Read article <a href=\"http:\/\/www.dallasnews.com\/business\/personal-finance\/headlines\/20140502-everyone-needs-an-estate-plan-regardless-of-wealth.ece\">here<\/a>.]<\/p>\n<p><strong>* Highlights from Census of Agriculture.<\/strong>\u00a0 Southeast Farm Press ran an article pointing out some highlights from the recently released 2012 Census of Agriculture.\u00a0 These include an increase in the number of beginning farmers, statistics showing that 30% of US farms are owned by women, and that more young farmers list farming as their primary occupation.\u00a0 [Read article <a href=\"http:\/\/southeastfarmpress.com\/government\/interesting-highlights-recent-census-agriculture?NL=SEFP-01&amp;Issue=SEFP-01_20140506_SEFP-01_71&amp;YM_RID=tdowell@tamu.edu&amp;YM_MID=1464447&amp;sfvc4enews=42&amp;cl=article_3\">here<\/a>.]<\/p>\n<p><strong>*\u00a0 Register Now for Texas Agricultural Law Course!<\/strong>\u00a0 I was thrilled to be asked to serve on the planning committee for the 8th Annual John Huffaker Agricultural Law Course, which will be held in Lubbock on May 29 and 30.\u00a0 It will be a great course with a variety of topics including the Farm Bill, legal issues facing the Texas wine industry, succession planning, animal rights law, the impact of immigration law on farmers and ranchers, an overview of the Endangered Species Act, water law updates,\u00a0 mineral leasing tips, and more.\u00a0 I&#8217;m excited to be attending, hope to see you there!\u00a0 For information on registration, <a href=\"http:\/\/www.texasbarcle.com\/materials\/Programs\/2913\/Brochure.pdf\">click here<\/a>.<\/p>\n<p><strong>Ranchers Leasing Workshop is now available on demand to be taken anytime at your own pace.
