[Read Complaint <\/span><a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/jnvwjeeakpw\/McDonald's%20v%20Cargill%20-%20EDNY%20-%2020241004.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\"> and article <\/span><a href=\"https:\/\/apnews.com\/article\/mcdonalds-sues-meat-packers-beef-price-fixing-6ea9d046eb711fd2a93d03305fa07882\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">.]<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><strong>*United States Supreme Court will hear dispute over nuclear waste storage facility in West Texas.<\/strong><span data-contrast=\"auto\">\u00a0 The United States Supreme Court has granted certiorari in <\/span><i><span data-contrast=\"auto\">Nuclear Regulatory Commission v. Texas<\/span><\/i><span data-contrast=\"auto\"> and <\/span><i><span data-contrast=\"auto\">Interim Storage Partners, LLC v. Texas<\/span><\/i><span data-contrast=\"auto\">, consolidated cases involving a proposed nuclear waste storage site in Andrews County, Texas.\u00a0 Lower courts ruled the facility could not go forward, but the NRC and Interim Storage Partners sought, and been granted, review from the Supreme Court. The legal issue in play is whether the government can license private entities to store nuclear waste away from the sites where the waste was generated.\u00a0 The oral argument date has not been announced yet.\u00a0 [Read article <\/span><a href=\"https:\/\/www.rawstory.com\/fight-over-west-texas-nuclear-waste-plan-to-hit-u-s-supreme-court\/\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">.]<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><strong>*USDA continuing ERP 2022 payments under new methodology. <\/strong><span data-contrast=\"auto\">We are a little behind on this news, but we wanted to be sure we included it. \u00a0In August, the USDA announced\u00a0it will resume payments under the ERP 2022 program. \u00a0You may recall from <\/span><a href=\"https:\/\/agrilife.org\/texasaglaw\/2024\/06\/24\/federal-judge-enjoins-usda-from-using-socially-disadvantaged-farmer-rancher-category-in-making-erp-2022-payments\/\"><span data-contrast=\"none\">this prior blog post<\/span><\/a><span data-contrast=\"auto\">, a Texas federal court previously issued an injunction preventing the USDA from continuing to make payments using a formula giving a monetary advantage to \u201csocially disadvantaged\u201d producers. In light of this injunction, the USDA announced it will go forward with ERP 2022 payments but will not make the adjustments previously afforded to \u201csocially disadvantaged producers.\u201d \u00a0[See Notice <\/span><a href=\"https:\/\/www.fsa.usda.gov\/Internet\/FSA_Notice\/erp_27.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">.]<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><strong>*US Court of Appeals for the Ninth Circuit dismisses claim challenging CAFO permitting by EPA.<\/strong><span data-contrast=\"auto\">\u00a0 The United States Court of Appeals for the Ninth Circuit has dismissed the claims in <\/span><i><span data-contrast=\"auto\">Food &amp; Water Watch v. EPA<\/span><\/i><span data-contrast=\"auto\">.\u00a0 Here, a number of activist groups filed suit against the EPA afte<\/span><span data-contrast=\"auto\">r the agency\u2019s<\/span><span data-contrast=\"auto\"> denial of the groups\u2019 request to initiate a rulemaking to modify regulations related to confined animal feeding operation (CAFO) discharges under the Clean Water Act.\u00a0 The EPA denied the request, but did determine it would create a committee and initiate a study to investigate the issue and determine the efficacy of current regulations. The Petitioners sought judicial review.\u00a0 The court dismissed the case, finding that the EPA did not act unreasonably in denying the petition as it took other action to determine if an issue existed.\u00a0 [Read Order <\/span><a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/memoranda\/2024\/10\/02\/23-2146.pdf\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\"> and article <\/span><a href=\"https:\/\/www.nationalhogfarmer.com\/farming-business-management\/pork-producers-applaud-ninth-circuit-decision-on-cafo-rules\"><span data-contrast=\"none\">here<\/span><\/a><span data-contrast=\"auto\">.]<\/span><span data-ccp-props=\"{}\">\u00a0<\/span><\/p>\n<p><strong>*Texas sues federal government over Endangered Species Act listing of dunes sagebrush lizard.<\/strong><span data-contrast=\"auto\">\u00a0 Texas has filed suit claiming the federal government violated the Administrative Procedures Act and the Endangered Species Act when it listed the dunes sagebrush lizard earlier this year.
