{"id":1203,"date":"2014-03-07T05:23:43","date_gmt":"2014-03-07T11:23:43","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=1203"},"modified":"2026-04-17T15:34:37","modified_gmt":"2026-04-17T20:34:37","slug":"march-7-2014-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/03\/07\/march-7-2014-weekly-round-up\/","title":{"rendered":"March 7, 2014 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #800000;\">*This article is not a substitute for the advice of an attorney.*<\/span><\/p>\n<p>Here are a look at some of the ag law stories making news this first week of March.<\/p>\n<p><strong>*United States\u00a0Sides with Texas in Water Dispute against New Mexico, Seeks to Join Suit.<\/strong>\u00a0 Last week, the Solicitor General, on behalf of the United States, filed a Motion for Leave to Intervene as a Plaintiff in the Supreme Court case pitting Texas against New Mexico in a battle over water in the Rio Grande.\u00a0\u00a0The Solicitor General echoed the arguments made by the State of Texas.\u00a0 Specifically, the\u00a0brief\u00a0explained the United States&#8217; position that &#8220;[w]hen water is extracted from the surface or the ground at places below Elephant Butte Reservoir, it affects surface water deliveries downstream.\u00a0 The Project may have to release additional water from storage to offset such extractions in order to maintain delivery of any given quantity of water to downstream users.\u00a0 Consequently, extraction of water that is hydrologically connected to the Rio Grande below Elephant Butte Reservoir has an effect on the amount of water stored in the Project that is available for delivery to [the project beneficiaries.]&#8221;\u00a0 [Read Motion <a href=\"http:\/\/www.documentcloud.org\/documents\/1031342-no-141-texas-v-new-mexico.html#document\/p2\">here<\/a>.]<\/p>\n<p><strong>* OSHA Dismisses Case Against Small Farm.<\/strong>\u00a0 Following pressure from Congress, the Occupational Safety and Health Administration (&#8220;OSHA&#8221;) moved to dismiss its case against a small Nebraska farm involving grain bins.\u00a0 OSHA had fined the farm, which employs only one person, $132,000 for permitting violations.\u00a0 Senator Mike Johanns became involved and argued that OSHA funds could not be used to regulate farms with fewer than 10 employees.\u00a0 &#8220;OSHA had no business regulating this family farm to begin with.&#8221;\u00a0 I&#8217;m pleased they are doing the right thing by correctly dropping the case.\u00a0 Producers shouldn&#8217;t have to worry about the government placing undue and illegal burdens on their operations.\u00a0 The law clearly exempts small farms from OSHA regulations, and I&#8217;m glad the agency took this step to get back in line with the law,&#8221; said Johanns.\u00a0 [Read article <a href=\"http:\/\/farmfutures.com\/story-osha-drops-grain-bin-case-against-small-farm-0-109460\">here<\/a>.]<\/p>\n<p><a href=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/03\/barn.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1212 aligncenter\" alt=\"barn\" src=\"http:\/\/agrilife.org\/texasaglaw\/files\/2014\/03\/barn-300x292.jpg\" width=\"300\" height=\"292\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2014\/03\/barn-300x292.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2014\/03\/barn.jpg 320w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p><strong>*\u00a0 Idaho Governor Signs &#8220;Ag Gag&#8221; Bill Into Law.<\/strong>\u00a0 The controversial &#8220;ag gag&#8221; bill has now become law in Idaho, making unauthorized filming of agricultural facilities a misdemeanor.\u00a0 [Read text of bill <a href=\"http:\/\/www.legislature.idaho.gov\/legislation\/2014\/S1337.pdf\">here<\/a>.]\u00a0So-called &#8220;ag gag&#8221;
