{"id":1193,"date":"2014-03-05T05:27:09","date_gmt":"2014-03-05T11:27:09","guid":{"rendered":"http:\/\/agrilife.org\/texasaglaw\/?p=1193"},"modified":"2026-04-17T15:34:37","modified_gmt":"2026-04-17T20:34:37","slug":"february-2014-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2014\/03\/05\/february-2014-weekly-round-up\/","title":{"rendered":"February 2014 Weekly Round Up"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"color: #800000;\">*This article is not a substitute for the advice of an attorney.*<\/span><\/p>\n<p>As you may have noticed, weekly round ups have been missing for the past couple of weeks.\u00a0 I hope to continue the weekly updates of ag law news, and here is a list of major ag law stories that made the news in the month of February.<\/p>\n<p><strong>*\u00a0 Denton Residents Seek Signatures for Fracking Ban.<\/strong>\u00a0 Citizens of Denton, Texas,\u00a0seek to become the first city in the state to ban fracking within its bounds.\u00a0\u00a0The Denton Drilling Awareness Group is\u00a0currently gathering signatures for a proposed\u00a0initiative that would\u00a0prohibit fracking within city limits.\u00a0 If the required 571 signatures are obtained, the proposal would appear on the election ballot in May or November.\u00a0 If passed, proponents expect legal challenges\u00a0by oil and gas companies and others.\u00a0 [Read article <a href=\"http:\/\/www.texastribune.org\/2014\/02\/18\/denton-group-seeks-local-fracking-ban\/\">here<\/a>.]<\/p>\n<p><strong>*Nebraska Law Allowing Governor To Approve Keystone Pipeline Route Ruled Unconstitutional.<\/strong>\u00a0 Nebraska State Court Judge Stephanie Stacy held that a state statute, which gave the Nebraska governor the power to approve the Keystone Pipeline route and authorize eminent domain, was unconstitutional.\u00a0 Specifically, Judge Stacy found\u00a0LB1161 improper because the decision to\u00a0approve the route and grant eminent domain power\u00a0should have been made by the Nebraska Public Service Commission rather than by the Governor.\u00a0\u00a0Judge Stacy&#8217;s decision\u00a0will be appealed by the Nebraska Attorney General.\u00a0 [Read articles <a href=\"http:\/\/www.foxnews.com\/politics\/2014\/02\/19\/judge-strikes-down-nebraska-law-that-allowed-keystone-pipeline-to-proceed\/\">here<\/a> and <a href=\"http:\/\/www.sunherald.com\/2014\/02\/19\/5352573\/nebraska-law-that-allowed-keystone.html\">here<\/a>.]<\/p>\n<p><strong>*\u00a0 Missouri Sues California Over Egg Production Law.\u00a0 <\/strong>The Missouri Attorney General has filed suit in California federal court seeking to invalidate a California law that will, beginning in 2015, prohibit the sale of eggs in California if the chickens that produced them were raised in cages that would violate California law.\u00a0 The lawsuit claims that\u00a0the\u00a0California law\u00a0infringes on interstate commerce by imposing new production requirements on out of state farmers.\u00a0 &#8220;If California legislators are permitted to mandate the size of chicken coops on Missouri farms, they may just as easily demand that Missouri soybeans be harvested by hand or that Missouri corn be transported by solar-powered trucks,&#8221;
