This year was no exception.\u00a0 Here is a look at some of the key agricultural law stories over the past couple of weeks from around the country.<\/p>\n<div id=\"attachment_11776\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-11776\" class=\"size-large wp-image-11776\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2022\/12\/federica-giusti-XTNyfggdKTo-unsplash-1024x682.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2022\/12\/federica-giusti-XTNyfggdKTo-unsplash-1024x682.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2022\/12\/federica-giusti-XTNyfggdKTo-unsplash-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2022\/12\/federica-giusti-XTNyfggdKTo-unsplash-768x511.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2022\/12\/federica-giusti-XTNyfggdKTo-unsplash-1536x1023.jpg 1536w, https:\/\/agrilife.org\/texasaglaw\/files\/2022\/12\/federica-giusti-XTNyfggdKTo-unsplash-2048x1364.jpg 2048w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-11776\" class=\"wp-caption-text\"><em>Photo by <a href=\"https:\/\/unsplash.com\/@federicagiusti?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">Federica Giusti<\/a> on <a href=\"https:\/\/unsplash.com\/photos\/XTNyfggdKTo?utm_source=unsplash&amp;utm_medium=referral&amp;utm_content=creditCopyText\">Unsplash<\/a><\/em><\/p><\/div>\n<p><strong>*Biden administration releases final WOTUS Rule.<\/strong>\u00a0 The Biden administration released the pre-publication version of their &#8220;Waters of the United States&#8221; definition.\u00a0 The 600-page document goes into significant detail about the new regulatory definition.\u00a0 The Rule will be effective 60 days after it is published in the Federal Register.\u00a0 Lawsuits will certainly follow.\u00a0 [Read Rule <a href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2022-12\/Pre-Publication%20Final%20Rule%20Notice.pdf?fbclid=IwAR0Bg7BSEJCd4INIGHBRyYsNSuwPWlt12WSy6Nc5ir44EchNuvUxuCKVhRU\">here<\/a>.]\u00a0 Of course, we will have both a blog post summary and a podcast episode coming in the near future.<\/p>\n<p><b>*North Carolina Supreme Court will not hear appeal in Right to Farm case.\u00a0\u00a0<\/b>In a case we&#8217;ve been watching for several years out of North Carolina, an appellate court decision upholding the constitutionality of the North Carolina Right to Farm statute will stand as the state&#8217;s Supreme Court has denied a petition for review.\u00a0 [Read article <a href=\"https:\/\/www.carolinajournal.com\/state-supreme-court-rejects-lawsuit-over-hog-farm-rules\/\">here<\/a>.]<\/p>\n<p><strong>*Federal appellate court will reconsider opinion in Round Up case.<\/strong>\u00a0 The US Court of Appeals for the Eleventh Circuit has announced it will reconsider it&#8217;s October 28, 2022 ruling relating to the interaction between federal pesticide law and state failure-to-warn claims.\u00a0 The court&#8217;s October 28 opinion reversed a district court decision that found the Federal Insecticide, Fungicide, and Rodenticide Act pre-empts state failure to warn claims in a case brought by a Georgia resident claiming that Round Up caused his cancer.\u00a0 The plaintiff claims that Bayer should have included a cancer warning label on its Round Up product, and the failure to do so violated state law.\u00a0 Bayer argues that doing so would have violated FIFRA as it would conflict with its EPA-approved label.\u00a0 The case will now be heard <em>en banc<\/em> (meaning before the all judges on the US Court of Appeals for the Eleventh Circuit).\u00a0 [Read article <a href=\"https:\/\/www.agri-pulse.com\/articles\/18641-appeals-court-decides-to-rehear-roundup-fifra-case?utm_source=Instant+Update&amp;utm_campaign=3c94971128-EMAIL_CAMPAIGN_2017_02_23_COPY_4119&amp;utm_medium=email&amp;utm_term=0_288ff2b53a-3c94971128-48737261\">here<\/a>.]<\/p>\n<p><strong>*Proposed consent decree released in\u00a0<em>Texas v. New Mexico<\/em> water law case.<\/strong>\u00a0 The proposed consent decree in <em>Texas v. New Mexico <\/em>has been released.\u00a0 Remember, the states have agreed to this, but the United States, which intervened in the case, objects.\u00a0 A hearing on this will occur in February.\u00a0 [Read proposed decree <a href=\"https:\/\/agrilife.org\/texasaglaw\/files\/2023\/01\/here.pdf\">here<\/a>.]<\/p>\n<p><strong>*John Deere and American Farm Bureau Federation sign memorandum of understanding addressing right to repair.<\/strong>\u00a0 The American Farm Bureau Federation and John Deere have entered into a memorandum of understanding under which John Deere has agreed to provide electronic access to the manuals, software, and tools &#8220;necessary for operation, maintenance, repair, or upgrade&#8221; of its equipment.
