[Find opinions <a href=\"https:\/\/www.txcourts.gov\/supreme\/orders-opinions\/2022\/june\/june-24-2022\/\">here<\/a>.]\u00a0 I&#8217;ll have a full blog post breaking down this decision next week.\u00a0 In the next month, I&#8217;ll also have a podcast episode with Luke Ellis looking at this decision as well as the Texas Supreme Court&#8217;s ruling in <em>Hlavinka v. HSC Pipeline<\/em>.\u00a0 Meanwhile, just weeks before the decision was announced, Texas Central&#8217;s CEO announced he was resigning.\u00a0 [Read article <a href=\"https:\/\/www.theleadernews.com\/business\/bullet-train-project-in-limbo-with-ceos-resignation\/article_d32bb692-ec96-11ec-8094-c70916abeb00.html\">here<\/a>.]<\/p>\n<p><strong>*US Supreme Court limits EPA authority under the Clean Air Act.<\/strong>\u00a0 I&#8217;ll have a blog post on this decision coming soon, but my friend Brianna Schroeder wrote a good, short summary on the\u00a0<em>West Virginia v. EPA decision<\/em> on her blog <a href=\"https:\/\/www.aglaw.us\/schroeder-ag-law-blog\/2022\/6\/30\/scotus-limits-epas-clean-air-act-power\">here<\/a>.<\/p>\n<p><strong>*US Supreme Court denies Petition for Certiorari in Montana Beef Checkoff case.<\/strong>\u00a0 Last week, the United States Supreme Court denied R-Calf&#8217;s Petition for Certiorari in\u00a0<em>Ranchers Cattlemen Action Legal Fund United Stockgrowers of America v. Vilsack.\u00a0<\/em>You may recall that this lawsuit challenged the legality of the beef checkoff in Montana and several other states, including Texas.\u00a0 In 2020, the US District Court for the District of Montana dismissed the case.\u00a0 [Read blog post <a href=\"https:\/\/agrilife.org\/texasaglaw\/2020\/04\/06\/montana-court-rules-in-favor-of-beef-checkoff\/\">here<\/a>.]\u00a0 In June of last year, the US Court of Appeals for the Ninth Circuit affirmed.\u00a0 [Read opinion <a href=\"https:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2021\/07\/27\/20-35453.pdf\">here<\/a>.]\u00a0 Still in play is a second lawsuit filed by R-Calf challenging the USDA&#8217;s memorandums of understanding with various of the qualified state beef councils.\u00a0 In September of 2021, the US District Court for the District of Columbia denied the USDA&#8217;s Motion to Dismiss this lawsuit, and it remains pending.<\/p>\n<p><strong>*Solicitor General files amicus brief supporting American Farm Bureau Federation and National Pork Producers in Proposition 12 case.<\/strong>\u00a0 You may recall that the US Supreme Court has agreed to hear a legal challenge to California&#8217;s Proposition 12, which requires all pork sold in California to meet with certain production standards.
