{"id":10653,"date":"2021-11-12T14:12:43","date_gmt":"2021-11-12T20:12:43","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=10653"},"modified":"2026-04-17T15:16:28","modified_gmt":"2026-04-17T20:16:28","slug":"november-12-2021-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2021\/11\/12\/november-12-2021-weekly-round-up\/","title":{"rendered":"November 12, 2021 Weekly Round Up"},"content":{"rendered":"<p>Welcome to another agricultural law weekly round up.\u00a0 Here are some of the stories in the news over the past couple of weeks.<\/p>\n<p><strong>*PRF (Rainfall Insurance) deadline is December 1 for 2022 sign up.<\/strong>\u00a0 Did you know you can purchase rainfall insurance?\u00a0 Essentially, PRF insurance allows you to insure a percentage of normal rainfall for your area, and you trigger a payment if rainfall falls below your insured percentage.\u00a0 This can be a great risk management tool for livestock producers who have cattle or other livestock on grass.\u00a0 You can purchase this product through your crop insurance agent.\u00a0 For more info, <a href=\"https:\/\/traffic.libsyn.com\/secure\/aglaw\/Jason_FINAL.m4a\">here is a prior podcast episode<\/a>\u00a0you can listen to where I interviewed Dr. Jason Johnson and\u00a0<a href=\"https:\/\/amarillo.tamu.edu\/agecon\/2020\/10\/12\/high-plains-ag-week-10-12-2020\/\">here is a blog post<\/a>\u00a0that Dr. Justin Benavidez wrote on PRF insurance.<\/p>\n<p><strong>*Texas passes bill prohibiting tethering of dogs; exceptions for agriculture exist.<\/strong>\u00a0 I&#8217;ve gotten a number of questions in the last couple of weeks about recently-passed Senate Bill 5 and what that may mean for Texas dog owners who use working dogs in agriculture.\u00a0 The bill prohibits leaving a dog outside and unattended by the use of restraint unless the dog has access to shelter, area allowing the dog to avoid standing water or animal waste, shade, and potable water.\u00a0 \u00a0Additionally, there are a number of exceptions to this prohibition, many of which apply (or could apply) to dogs used in agricultural production including exceptions for: (1) &#8220;the use of a restraint on a dog while the owner and dog engage in conduct directly related to the business of shepherding or herding cattle or livestock,&#8221; (2) \u201cthe use of a restraint on a dog while the owner and dog engage in conduct directly related to the business of cultivating agricultural products,\u201d (3) \u201ca dog left in an open-air truck bed only for the time reasonably necessary for the owner to complete a temporary task that requires the dog to be left unattended in the truck bed,\u201d and (4) &#8220;a dog taken by the owner\u2026from the owner\u2019s residence or property and restrained by the owner&#8230;for not longer than the time necessary for the owner to engage in an activity that requires the dog to be temporarily restrained.\u201d\u00a0 A violation of the law can result in criminal penalties.\u00a0 The effective date of the bill is January 18, 2022.\u00a0 [Read full text <a href=\"https:\/\/capitol.texas.gov\/tlodocs\/873\/billtext\/pdf\/SB00005F.pdf#navpanes=0\">here<\/a>.]<\/p>\n<div id=\"attachment_10675\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-10675\" class=\"wp-image-10675 size-full\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2021\/11\/dog-g46129672f_640.jpg\" alt=\"\" width=\"640\" height=\"427\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2021\/11\/dog-g46129672f_640.jpg 640w, https:\/\/agrilife.org\/texasaglaw\/files\/2021\/11\/dog-g46129672f_640-300x200.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-10675\" class=\"wp-caption-text\"><em>Image by <a href=\"https:\/\/pixabay.com\/users\/couleur-1195798\/?utm_source=link-attribution&amp;utm_medium=referral&amp;utm_campaign=image&amp;utm_content=5294637\">Couleur<\/a> from <a href=\"https:\/\/pixabay.com\/?utm_source=link-attribution&amp;utm_medium=referral&amp;utm_campaign=image&amp;utm_content=5294637\">Pixabay<\/a><\/em><\/p><\/div>\n<p><strong>* Texas Supreme Court grants motion for rehearing, sets oral arguments in lawsuit challenging High Speed Rail. <\/strong> The Texas Supreme Court has reconsidered its decision in June that it would not hear an appeal in <em>Miles v. Texas Central Railroad &amp; Infrastructure<\/em>. On October 15, 2021, the Texas Supreme Court granted Miles&#8217; Motion for Reconsideration.\u00a0 [Read Order <a href=\"https:\/\/search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=5c39c357-1b3e-4eeb-a2b9-4864c206970d&amp;coa=cossup&amp;DT=SUBMISSION%20SET&amp;MediaID=b14b29a9-8f88-432f-a6b2-fb591c8cf7fe\">here<\/a>.]\u00a0 Oral argument has been set for January 11, 2022.\u00a0 At issue is a\u00a0\u00a0Corpus Christi Court of Appeals ruling that Texas Central is considered a &#8220;railroad company&#8221; and an &#8220;interurban railroad,&#8221; thereby giving it eminent domain power to condemn land for the high speed rail.\u00a0 To read my prior article on that Court of Appeals decision, <a href=\"https:\/\/agrilife.org\/texasaglaw\/2020\/05\/18\/bullet-train-ruling\/\">click here<\/a>.<\/p>\n<p><strong>*Texas court pauses ban on Delta-8 THC.<\/strong>\u00a0 In an ongoing situation regarding cannabis plants, the issue of Delta-8 THC has caused a good deal of confusion.\u00a0 In particular, the question is whether products containing Delta-8 THC should be considered a controlled substance (and thereby illegal) in Texas, or, as plaintiffs argue, did the Texas law allowing for hemp production, make products containing Delta-8 THC legal?
