{"id":10185,"date":"2021-07-16T01:13:06","date_gmt":"2021-07-16T06:13:06","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=10185"},"modified":"2026-04-17T15:16:45","modified_gmt":"2026-04-17T20:16:45","slug":"july-16-2021-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2021\/07\/16\/july-16-2021-weekly-round-up\/","title":{"rendered":"July 16, 2021 Weekly Round Up"},"content":{"rendered":"<p>I&#8217;m not sure how this happened, but it is the middle of July and the summer is flying by.\u00a0 There are plenty of agricultural law stories in the news.<\/p>\n<div id=\"attachment_10310\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-10310\" class=\"size-large wp-image-10310\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2021\/07\/20210617_Sunflowers_LM_0012-1-1024x683.jpg\" alt=\"\" width=\"640\" height=\"427\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2021\/07\/20210617_Sunflowers_LM_0012-1-1024x683.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2021\/07\/20210617_Sunflowers_LM_0012-1-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2021\/07\/20210617_Sunflowers_LM_0012-1-768x512.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2021\/07\/20210617_Sunflowers_LM_0012-1.jpg 1200w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-10310\" class=\"wp-caption-text\"><em>Photo via Laura McKenzie\/Texas A&amp;M AgriLife Marketing and Communications<\/em><\/p><\/div>\n<p><strong>*President Biden addresses several agricultural issues in Executive Order Promoting Competition in the American Economy.<\/strong>\u00a0 President Biden recently issued his Executive Order on Promoting the Competition in the American Economy.\u00a0 [Read Fact Sheet <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/07\/09\/fact-sheet-executive-order-on-promoting-competition-in-the-american-economy\/\">here<\/a>.]\u00a0 This Executive Order addresses a number of issues, including several related to agriculture.\u00a0 Namely, the Executive Order: (1) directs USDA to consider new rules under the Packers and Stockyards Act to make it easier for farmers to successfully make claims; (2) directs USDA to consider promulgating new rules about when meat may be labeled &#8220;Product of the USA&#8221;; (3) Directs USDA to support alternative food distribution systems and develop standards and labels for such markets; and (4) encourages the FTC to limit equipment manufacturers from restricting a person&#8217;s right to repair, such as limitations on farmers&#8217; rights to repair tractors.\u00a0 [Read article <a href=\"https:\/\/www.agweb.com\/news\/policy\/politics\/biden-sides-farmers-over-right-repair-tractor-software-battle?fbclid=IwAR2weq-i0qG6zuwKXWWhz_BwfuP1IWlNwlPvkypWnUz2gHhk5YQ4j3uwElQ\">here<\/a> and listen to prior podcast episode on the Right to Repair <a href=\"https:\/\/aglaw.libsyn.com\/episode-31-todd-janzen-right-to-repair\">here<\/a>.]<\/p>\n<p><strong>*Courts issue injunctions and certify classes in challenges to USDA loan repayment for socially disadvantaged farmers and ranchers.<\/strong>\u00a0 You may recall from prior posts there have been several lawsuits filed challenging the legality of Section 1005 of the American Rescue Plan Act, which would pay up to 120% of eligible loan balances to socially disadvantaged farmers and ranchers.<\/p>\n<p>In\u00a0<em>Miller v. Vilsack<\/em>, the US District Court for the Northern District of Texas issued a preliminary injunction against the debt relief program and certified two classes to challenge the program.\u00a0 The two certified classes consist of US farmers who do not meet the definition of a socially disadvantaged farmer or rancher in Section 1005.\u00a0 The injunction will prohibit USDA from \u201cdiscriminating on account of race or ethnicity\u201d in carrying out the loan forgiveness program, including \u201cconsidering or using an applicant Class Member\u2019s race or ethnicity as a criterion\u201d or \u201cconsidering or using any criterion that is intended to serve as a proxy for race or ethnicity\u201d in determining eligibility for loan forgiveness.\u00a0 [Read Order <a href=\"https:\/\/www.courtlistener.com\/docket\/59854677\/60\/miller-v-vilsack\/\">here<\/a>.]<\/p>\n<p>Similarly, in <em>Wynn v. Vilsack<\/em>, a Florida federal court issued a preliminary injunction in a lawsuit claiming Section 1005 violated the equal protection and due process clauses and violated the Administrative Procedures Act.\u00a0 The court granted the motion for injunction, finding that Section 1005 was not sufficiently narrowly tailored as well as being both over- and under-inclusive.\u00a0 Because the court found the plaintiff likely to succeed on the merits, the preliminary injunction was granted, thereby halting any payments under Section 1005 until further notice from the court. [Read Order <a href=\"https:\/\/www.calt.iastate.edu\/files\/wynn_v._vilsack.pdf\">here<\/a> and article <a href=\"https:\/\/nationalaglawcenter.org\/judges-order-halts-minority-debt-relief-payments\/\">here<\/a>.]<\/p>\n<p><strong>*FSA announces new indemnity program for livestock and poultry producers due to pandemic.<\/strong>\u00a0 Livestock and poultry producers who suffered losses due to insufficient access to processing facilities may qualify for the newly announced Pandemic Livestock Indemnity Program (PLIP).\u00a0 The program is designed to offer indemnity to producers who depopulated herds during the pandemic from March 1, 2020 through December 26, 2020.\u00a0 \u00a0Applications will be taken from July 20 &#8211; September 17 at local FSA offices.\u00a0 Payments will be based on 80% of the fair market value of the animals and the cost of depopulation and disposal.\u00a0 Chickens, turkeys, and swine qualify for the program, but packers, live poultry dealers, and contract growers are not eligible.\u00a0 Payments will be reduced by any payments received for disposal under EQUIP or any other state program, and by any CFAP 1 and 2 payments made on the same inventory of swine depopulated.\u00a0 [Read press release <a href=\"https:\/\/www.usda.gov\/media\/press-releases\/2021\/07\/13\/usda-provide-pandemic-assistance-livestock-producers-animal-losses\">here<\/a>.]<\/p>\n<p><strong>*Mississippi Supreme Court dismisses lawsuit relying on Right to Farm Statute in lawsuit alleging propane cannon to scare deer from fields was nuisance.<\/strong>\u00a0 In\u00a0<em>Briggs v.
