{"id":10020,"date":"2021-05-07T10:34:19","date_gmt":"2021-05-07T15:34:19","guid":{"rendered":"https:\/\/agrilife.org\/texasaglaw\/?p=10020"},"modified":"2026-04-17T15:17:07","modified_gmt":"2026-04-17T20:17:07","slug":"may-7-2021-weekly-round-up","status":"publish","type":"post","link":"https:\/\/agrilife.org\/texasaglaw\/2021\/05\/07\/may-7-2021-weekly-round-up\/","title":{"rendered":"May 7, 2021 Weekly Round Up"},"content":{"rendered":"<p>Happy May!\u00a0 Here are a few of the ag law stories in the news over the past couple of weeks.<\/p>\n<div id=\"attachment_10051\" style=\"width: 650px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-10051\" class=\"wp-image-10051 size-large\" src=\"https:\/\/agrilife.org\/texasaglaw\/files\/2021\/05\/bluebonnets-1024x681.jpg\" alt=\"\" width=\"640\" height=\"426\" srcset=\"https:\/\/agrilife.org\/texasaglaw\/files\/2021\/05\/bluebonnets-1024x681.jpg 1024w, https:\/\/agrilife.org\/texasaglaw\/files\/2021\/05\/bluebonnets-300x200.jpg 300w, https:\/\/agrilife.org\/texasaglaw\/files\/2021\/05\/bluebonnets-768x511.jpg 768w, https:\/\/agrilife.org\/texasaglaw\/files\/2021\/05\/bluebonnets.jpg 1097w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><p id=\"caption-attachment-10051\" class=\"wp-caption-text\"><em>Photo by Laura McKenzie, Texas A&amp;M Marketing and Communications<\/em><\/p><\/div>\n<p>&nbsp;<\/p>\n<p><b>*Three laws every rural landowner in Texas should know.\u00a0\u00a0<\/b>I recently chatted with Texas Standard and offered three key laws I think that every rural landowner should know.\u00a0 See what made my list <a href=\"https:\/\/www.texasstandard.org\/stories\/three-laws-every-rural-landowner-in-texas-should-know\/\">here<\/a>.<\/p>\n<p><strong>*President Biden mentions exception for farms in proposal to increase capital gains taxes and do away with stepped up basis.<\/strong>\u00a0 There have been numerous articles discussing President Biden&#8217;s proposal to increase the capital gains tax rate and to do away with the step up in basis.\u00a0 The White House has said this proposal will not affect family farms or small family businesses.\u00a0 The proposal includes a provision that the first $1 million\/ person in gains would not be taxed.\u00a0 [Read USDA Fact Sheet <a href=\"https:\/\/www.usda.gov\/media\/press-releases\/2021\/04\/28\/american-families-plan-honors-americas-family-farms\">here<\/a>.] Thirteen democrats, mostly members of the House Agriculture Committee, have sent a letter to House leadership seeking to ensure a full exemption from the cancellation of the step up in basis for family farms and family businesses.\u00a0 The letter included the following language: &#8220;The repeal of stepped-up basis for capital gains and immediate taxation could especially hurt family farms, some of which have been in families for generations; therefore, we strongly urge you to provide full exemptions for these family farms and small businesses that are critical to our communities.&#8221; [Read articles <a href=\"https:\/\/www.dtnpf.com\/agriculture\/web\/ag\/news\/business-inputs\/article\/2021\/05\/06\/rural-democrats-seek-bill-language?referrer=twitter#.YJReOU2zVLE.twitter\">here<\/a>, <a href=\"https:\/\/thehill.com\/policy\/finance\/552144-rural-democrats-urge-protections-from-tax-increases-for-family-farms\">here<\/a>, &amp; <a href=\"https:\/\/www.farmprogress.com\/farm-policy\/ag-industry-skeptical-bidens-tax-plan?NL=SWFP-01&amp;Issue=SWFP-01_20210429_SWFP-01_313&amp;sfvc4enews=42&amp;cl=article_2_b&amp;utm_rid=CPG02000000698080&amp;utm_campaign=58841&amp;utm_medium=email&amp;elq2=cbe6c4f60eeb48639d7ebc48f5c0fcad\">here<\/a>.]<\/p>\n<p>*<strong>US Court of Appeals for the Ninth Circuit Orders EPA to either ban Chlorpyrifos or set food residue tolerance in the next 60 days.<\/strong>\u00a0 The US Court of Appeals for the Ninth Circuit issued an opinion last week in litigation challenging the EPA&#8217;s actions related to the insecticide chlorpyrifos.\u00a0 &#8220;The court remands this matter to the EPA with instructions to publish a legally sufficient final response to the 2007 petition within 60 days of the issuance of the mandate. That response must be a final regulation that either revokes all chlorpyrifos tolerances or modifies chlorpyrifos tolerances and makes the requisite safety findings based on aggregate exposure, including with respect to infants and children,&#8221; said the court.\u00a0 Further complicating the issue is the fact that Corteva, the registrant and largest manufacturer of chlorpyrifos, has announced it will be discontinuing production of the product due to lack of demand.\u00a0 [Read opinion <a href=\"https:\/\/aglaw.psu.edu\/wp-content\/uploads\/2021\/05\/19-71979-Chlorpyrifos-Remand-to-EPA.pdf\">here<\/a> and article <a href=\"https:\/\/www.dtnpf.com\/agriculture\/web\/ag\/crops\/article\/2021\/04\/29\/fix-chlorpyrifos-risks-ban-ninth-epa\">here<\/a>.]<\/p>\n<p><strong>*Lawsuits filed against USDA challenging aid to socially disadvantaged farmers and ranchers.\u00a0<\/strong> In the past couple of weeks, lawsuits have been filed against the USDA challenging the constitutionality of provisions in the American Rescue Plan of 2021 that provide benefits and loan forgiveness to socially disadvantaged farmers and ranchers.
